1. Agreement to Terms
By accessing or using the NEX AI platform at nexaisolution.in, you agree to be bound by these Terms of Service and all applicable laws and regulations. These terms constitute a legally binding agreement between you and Nandaa AI Technology Pvt Ltd. If you do not agree to these terms, please do not use our services.
2. Services
NEX AI provides an AI-powered voice calling platform that enables businesses to automate lead qualification calls. Our services include automated outbound calling, lead scoring (HOT / WARM / COLD), call recordings, transcripts, campaign management, and related features. We reserve the right to modify, suspend, or discontinue any part of our services with reasonable notice.
3. Credits and Billing
Our platform operates on a credit-based billing model where 1 credit equals 1 minute of AI calling time. Credits are purchased in advance and are non-refundable once consumed. Unused credits do not expire as long as your account remains active and in good standing. A monthly platform fee applies to all active accounts as stated in our current pricing. All prices are in Indian Rupees (INR) and exclusive of applicable taxes.
4. Acceptable Use
You agree to use NEX AI only for lawful business purposes. You must not use our platform to send spam, conduct fraudulent activity, harass individuals, violate the privacy of others, or breach any applicable telecom regulations under TRAI guidelines. You are responsible for ensuring that the phone numbers you upload are from consenting individuals where required by law. We reserve the right to suspend accounts that violate these terms without refund.
5. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account. NEX AI will not be liable for any loss resulting from unauthorised use of your account where you have failed to maintain adequate security.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Nandaa AI Technology Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the NEX AI platform. Our total liability to you for any claims arising from your use of the services shall not exceed the amount you paid to us in the three months preceding the claim.
7. Termination
We may suspend or terminate your account and access to our services immediately and without prior notice if we determine, in our sole discretion, that you have violated these Terms of Service. Upon termination, your right to use the platform ceases immediately. Any credits remaining in your account at the time of termination for cause are forfeited.
8. Changes to Terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you by email or by posting a notice on our platform. Your continued use of NEX AI after such changes constitutes your acceptance of the new terms. We encourage you to review these terms periodically.
9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
